1. Who you are contracting with

Daily Holes (the "Service") is operated by Martin Seppälä ("we", "us", "our"), trading as Daily Holes, at dailyholes.com. By using the Service you enter into an agreement with Martin Seppälä. Questions about these terms can be sent to dailyholes.com@gmail.com.

2. Acceptance

By accessing, playing or continuing to use Daily Holes, you agree to these terms. If you do not agree, please stop using the Service. You confirm that you are of legal age in your country to enter into this agreement, or that you have permission from a parent or guardian.

3. What the Service is

Daily Holes is a browser-based golf game. Each day a new nine-hole course is generated and all players play the same course. One ranked round per day is free. Optional paid extras — a single replay (€0.89 including VAT), Club Starter (€2.49 per month including VAT), and Pro Club (€6.99 per month including VAT) — are described on our pricing page, and refunds are covered by our refund policy. Payments are processed by Stripe; the subscription renews monthly until cancelled and can be cancelled at any time from "Manage membership" in the game.

The Service is funded by advertising served through Google AdSense. Ads are labelled as such and are not endorsements by us; anything you buy from an advertiser is a contract between you and them, not with us. What the ads collect and how to opt out of personalised advertising is set out in our privacy notice.

4. Your account

You may play as a guest, but an account is required to save rounds, appear on leaderboards and add friends. You are responsible for keeping your login credentials confidential and for all activity under your account. You agree to provide accurate information and keep it up to date.

5. Acceptable use

You must not misuse the Service. In particular, you must not:

• use the Service for any unlawful purpose or in breach of any applicable law;
• commit fraud, send spam, or impersonate another person;
• infringe anyone's intellectual property or other rights;
• interfere with the security or integrity of the Service, including uploading malware, probing or scanning our systems, scraping, or overloading our infrastructure;
• cheat, submit falsified scores, automate gameplay, or otherwise manipulate leaderboards, streaks or challenge results;
• reverse engineer, resell, redistribute, or circumvent any technical limits of the Service.

6. Intellectual property

We retain all ownership of the Service and everything in it, including the game software, course generation, graphics, text and the Daily Holes name and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own personal, non-commercial enjoyment. Any display name, avatar or other content you submit remains yours; you grant us a limited licence to host and display it solely to operate the Service (for example, showing your name on a leaderboard).

7. Availability

We aim to keep Daily Holes running smoothly, but we do not guarantee that the Service will be uninterrupted, timely, secure or error-free. Courses, features, leaderboards and gameplay balance may change over time. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these terms, present a security or fraud risk, or repeatedly or seriously violate our acceptable use rules. We may also remove scores or leaderboard entries obtained by cheating. You may stop using the Service or ask us to delete your account at any time; when access ends, your stored rounds and profile data may be deleted in line with our privacy notice.

9. Liability

To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our total aggregate liability arising from the Service is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify us against claims, losses and costs arising from content you submit, your unlawful use of the Service, or your breach of these terms.

11. General

These terms are governed by the laws of Finland, and the courts of Finland have jurisdiction over any dispute, unless mandatory consumer law in your country of residence gives you the right to bring proceedings elsewhere. You may not assign this agreement without our consent; we may assign it in connection with a merger, acquisition or sale of the business. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms; material changes will be reflected in the "last updated" date above.
